Epic Systems, the largest electronic health records company in the country, claims that around 295,000 patient records have been wrongly obtained and used by unscrupulous characters. Epic Systems, run by its billionaire founder Judy Faulkner, has filed a suit revealing that so-called “bad actors” are taking advantage of medical facilities to steal sensitive information. But how do these folks manage to get their hands on data that people haven’t even told their families about? They seek out this information and then indulge in a little creative monetization—think selling your records to lawyers hunting for class action participants. Now that’s a surprise no one signed up for!

Although Epic is still gathering solid proof that this stolen data has actually been used to build legal cases, they’re not just throwing spaghetti at the wall to see what sticks. They’ve put forward some eye-opening evidence. One legal firm reportedly claims it can request and receive all your clients’ medical records in less than 48 hours. Another one is pushing for “same-day” retrieval of medical records. Talk about quick service! These lightspeed claims raise major red flags about the true purpose behind these requests, suggesting that some might be disguising their intentions as legitimate treatment needs.

Unfortunately, the story gets even murkier. The lawsuit points a finger at Health Gorilla, a healthcare tech firm, as an accomplice enabling these shady dealings. Epic argues that Health Gorilla is helping these characters gain access to medical records, clearly showing that not all gatekeepers are as trustworthy as they should be. Along with Epic, healthcare giants such as Reed Health and Trinity Health are backing this lawsuit, making it clear that this issue is not just a one-off incident but a systemic problem within the healthcare industry’s data-sharing systems.

Interoperability, a fancy term for the electronic exchange of patient data, is generally a good thing. It allows patients to avoid lugging around heavy binders full of medical records when visiting different providers. However, the rapid transformation of healthcare data sharing has created a complex web that can easily be manipulated. The nonprofit Care Quality, used by about 70% of U.S. hospitals and handling over 1.2 billion records monthly, is at the heart of the lawsuit’s allegations. With a small staff and limited vetting procedures, Care Quality could be leaving the door wide open for abuse, and the lack of accountability leaves patients in the dark about who has accessed their sensitive information.

As alarming as this all sounds, it’s worth mentioning that this isn’t Epic’s first rodeo. They have battled accusations of monopolistic practices before, and their heavy hand in the healthcare industry—serving around 42% of U.S. hospitals and generating a whopping $5.7 billion in revenue—has brought them under scrutiny. Depending on how this legal battle plays out, it may not only lead to greater protection for patients but also prompt necessary reforms in how healthcare data is shared across the country. One thing is clear: when it comes to medical privacy, it’s high time we all started taking a closer look at who’s got access to our very personal business!
