Supreme Court Ruling Shakes Up Election Laws, Dems Reeling

In recent political theater — with a capital T — it seems that the Supreme Court has become the center stage for quite the Broadway-esque drama, starring none other than Justice Ketanji Brown Jackson. According to some, she embodies the persona of those eccentric high school theater kids, now grown and ready to take center stage at the highest levels of at least judicial governance. When a Supreme Court Justice finds time for performing arts amidst constitutional review, one might wonder if we’re not all witnessing a bit of performance ourselves.

Justice Jackson’s latest performance, however, isn’t winning her any fans among conservatives — or even some moderates, for that matter. The controversy du jour revolves around her sole dissent in a Supreme Court decision involving a particularly wonky Louisiana district map that looked more like abstract art than a sensible political region. Now, this map didn’t just land on the drawing board by itself; rather, it’s an artifact of what some critics, including other Supreme Court members, call racial gerrymandering. When the Court decided to let Louisiana redraw the map to align with actual geographic — not demographic — logic, Justice Jackson’s dissent stood out, and not in a way that wins awards.

Part of the hullabaloo centers around the origins of Jackson’s position on the bench itself. Commentators point to President Biden’s professed commitment to nominating a black woman to the Supreme Court as something of an overplayed hand, suggesting that criteria less about merit and more about identity politics were at play. They argue that this decision reflects divisive racial preferences rather than judicial wisdom, with opponents suggesting it flies in the face of a clear constitutional mandate against discrimination.

In this discord lies another layer of drama: a simmering clash involving intellectual acumen on one side and perceived political pandering on the other. Apparently, not all the robes in the courthouse closet are pleased with the fellow jurist’s interpretations — or her theatrical war cries for justice. Allegations have surfaced that her dissents lack the gravity and jurisprudential rigor expected of the Supreme Court, boiling down to what critics call cheapened discourse.

Cue Justice Samuel Alito and others who reportedly delivered verbal backhands against Jackson’s position, labeling her opinions as trivial and baseless. They’ve taken her dissent to task on grounds that it appears more as a repetition of personal convictions rather than adherence to legal precedent. This intra-courtroom disagreement suggests a bit of a reality check for Justice Jackson as she continues this, well, dramatic dialogue with the court’s conservative old guard.

Perhaps in this melodrama lies a lesson: the highest court is no stage for grandstanding acts prone to lowest-common-denominator politics. Instead, decisions require a solid, thoughtful approach that transcends ephemeral identity politics or theatrical distractions. If Justice Jackson’s role is to strike a chord among liberals, she’ll likely need to expand her script beyond a one-woman show filled with contentious dissents.
